§ 1 Scope
These General Terms and Conditions apply to all orders placed through the YN Performance online shop. A consumer within the meaning of these terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.
§ 2 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but a non-binding online catalogue. By clicking the “Buy now” button, you place a binding order for the products in your shopping cart. The order confirmation by e-mail constitutes acceptance of the contract by the seller.
§ 3 Prices and shipping costs
All prices are in euros and include statutory VAT. Shipping costs are shown separately during the order process. Please refer to the shipping information in the shop for current rates.
§ 4 Payment
We accept credit card (Visa, Mastercard), PayPal, Klarna and other payment methods offered during the order process. In the event of late payment, we reserve the right to charge default interest at the statutory rate.
§ 5 Delivery
Delivery is made within Germany and to selected EU countries. The expected delivery time is stated on the respective product page. Unless otherwise stated, the delivery time is 3–7 working days within Germany.
§ 6 Retention of title
The delivered goods remain the property of the seller until full payment has been made.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. For details, please see our Right of Withdrawal.
§ 8 Warranty
The statutory rights regarding defects apply. The limitation period for claims for defects is two years from delivery of the goods.
§ 9 Limitation of liability
The seller is liable without limitation for damages resulting from injury to life, body or health, as well as for intent and gross negligence. Otherwise, liability is limited to typical, foreseeable damages.
§ 10 Data protection
Information on the collection and processing of personal data can be found in our Privacy Policy.
§ 11 Dispute resolution
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.
§ 13 Final provisions
Should individual provisions of these terms be invalid, this shall not affect the validity of the remaining provisions.
